"The taxing power of the Federal Government, my dear; the taxing power is sufficient for everything you want and need." This quote is more three quarters of a century old. It was uttered, or whispered, by Justice Harlan Stone to FDR's Labor Secretary Frances Perkins. Stone was responding to Perkins's question about how to get her new plans for a national pension program, what we know as Social Security, past the Supreme Court. As we learned today, the Supreme Court has ruled that the health care mandate is acceptable as a tax. “Because the Constitution permits such a tax, it is not our role to forbid it, or to pass upon its wisdom or fairness," Chief Justice John Roberts concluded.
