It was uttered, or whispered, by Justice Harlan Stone to FDR's Labor Secretary Frances Perkins. Stone was responding to Perkins's question about how to get her new plans for a national pension program, what we know as Social Security, past the Supreme Court. As we learned today, the Supreme Court has ruled that the health care mandate is acceptable as a tax. “Because the Constitution permits such a tax, it is not our role to forbid it, or to pass upon its wisdom or fairness," Chief Justice John Roberts concluded.
